    I don't wish to be rude, but technically, 'luff' and 'luffing' are highly ambiguous terms which have not been used or defined in the RRS since 1995. Their use almost always causes confusion in rules discussions. If you are talking and thinking in terms of 'luffing rights', then you are applying the wrong conceptual approach to the modern rules.

    Rule 17 is a limitation rule. It says that if you became overlapped within two of your hull lengths, and from clear astern, you shall not sail above your proper course. You can certainly sail above close hauled, pinching or luffing, up to the course you need to fetch the mark, but no higher.

    If you are the faster boat and aproach a slower boat and first establish the overlap within 2 boat lengths to leward you donot have luffing rights. But if you first establish the overlap more than 2 boat lengths to leward you can still sail any course you feel like.
